In his latest work, which is to be released in the upcoming book, “Constitutional Democracies in Crisis?,” Sujit Choudhry focuses on a recent tweet by Eric Holder in which he questions the potential firing of Robert Mueller, White House Special Counsel. In the upcoming chapter, Sujit Choudhry breaks down Eric Holder’s tweet about the end result for Robert Mueller by placing it into two separate categories; one being the red line that Holder asserts will have been crossed, and the other being the American people’s summation as to whether that line has actually been crossed. According to Sujit Choudhry, the underlying concept of Eric Holder’s tweet is formed on the basis of “constitutional self-enforcement,” which he believes does not require a decision in court to make it such, and he also believes, to his surprise, that Holder is fully aware of this, as he never considers or mentions the option of taking a legal approach. Sujit Choudhry also staunchly believes that these red lines described by Eric Holder, are a real representation of a full-scale failure in regards to democracy and its processes. If these red lines are not directly challenged by the American people, Sujit Choudhry believes that it could result in a US President or similar figure, attempting to remain in office for a period exceeding the two-term max allotted.
